DWI Intoxication

Just Exactly What Is Intoxication?

     I don't feel drunk!  Isn't that the same thing as intoxication?

     Texas Penal Code Section 49.01(2):

"Intoxicated" means: (A) not having the normal use of mental or physical faculties by reason of the introduction of alcohol, a controlled substance, a drug, a dangerous drug, a combinatin of two or more of those substandces, or any other substance into the body; or (B) having an alcohaol concentration of 0.08 or more.

     What this means in English is if you have taken in any alcohol or any drug, whether it's prescription or not, and you have lost the normal use of your mental or physical abilities...you're intoxicated against the law.

      Normal rested?  Normal tired? (I just got off a construction job!)  Normal sleepy? (I just got off the nightshift!)  Normal emotional? (I just broke up!)  Normal WHAT?  Does your normal change throughout the day?

      Well, who knows your normal self better....you?....your friend/passenger?...or a stranger who has never met you, but stops you out on the road?  And why does he make you do abnormal acts to see if you're normal?
