Penal Code 49.09 states:

Except as provided ... a [DWI] is a Class A misdemeanor, with a minimum term of confinement of 30 days, if it is shown on the trial of the offense that the person has previously been convicted one time of an offense relating to the operationjg of a motor vehicle while intoxicated...

Class A misdemeanor punishment range is: a fine not to exceed $4,000, confinement in county jail for a term not to exceed one year or both such fine and confinement.

However, the specific DWI law places a minimum term for a DWI conviction at 30 days in jail.
