Third DWI...a Third Degree Felony

A Felony Conviction Has Real Life Consequences

Generally, a third degree felony DWI is an arrest for a DWI when the person already has two previous convictions for DWI on his record.

A DWI arrest can also be a felony if the person has been convicted previously of an offense under Penal Code 49.08 which is Intoxication Manslaughter. (Please see the related section on a following page)

Standard third degree felony punishment is imprisonment in the institutional division (Penitentiary) for any term of not more than 10 years or less than 2 years.

In addition to imprisonment, an individual adjudged guilty of a felony of the third degree may be punished by a fine not to exceed $10,000.
