In Smith County, Texas, first and second DWI offenses are Class B misdemeanors and Class A misdemeanors, respectively, and those cases are heard in the Smith County Courts at Law. A third offense or a DWI with aggravating circumstances rises to felony level and moves to Smith County’s district courts. Note that the 321st District Court handles only family law matters, so felony DWI cases are assigned to one of the other district courts. Both the County Courts at Law and the district courts operate out of the Smith County Courthouse in Tyler.

Two Legal Processes Start at Arrest
A DWI arrest in Texas doesn’t start one legal process. It starts two: the criminal case in court and a separate civil license-suspension proceeding handled by the Texas Department of Public Safety. Each has its own deadlines, and missing the first one can cost you your license before your criminal case has even begun.
The ALR Deadline Is 15 Days
The Administrative License Revocation (ALR) process is the civil side of a DWI arrest. It’s a proceeding through the Texas Department of Public Safety, completely separate from the criminal court case, that determines whether your driver’s license will be suspended. You have 15 days from the date of arrest or notice to request an ALR hearing. If that hearing isn’t requested in time, the suspension takes effect automatically on the 40th day after notice, with no further opportunity to contest it.
Drivers whose licenses are suspended may be eligible to apply for an occupational license, which permits driving for essential needs such as work, school, and medical appointments. Acting quickly gives us the opportunity to contest the suspension and, if necessary, pursue occupational license eligibility on your behalf.
